Bên cạnh đó, cùng với việc ban hành “nội quy hướng dẫn thi công” mới, Mai Linh cũng giới thiệu 5 “đơn vị thi công uy tín” để khách hàng tìm hiểu, ký kết hợp đồng thi công hoàn thiện. 5 công ty được chủ đầu tư giới thiệu đó là: Công ty Cổ phần đầu tư xây dựng Khang Đạt; Công ty TNHH Thương Mại và Xây dựng Việt Châu; Công ty Cổ phần Thiết bị giám sát và Công trình Việt Nam; Công ty Cổ phần Kiến trúc và Xây dựng Việt Á; Công ty Cổ phần Kiến trúc và Nội thất Qualidecor.
Theo các khách hàng, họ đã tiến hành khảo sát, tìm hiểu “năng lực” của các công ty đó, nhưng đa phần đều cho kết quả không đáng tin cậy. 3/5 công ty được cho là có trụ sở không hoạt động và giá cả của hai công ty còn lại cao hơn khá nhiều so với giá thị trường.
Ngoài ra, công ty Mai Linh cũng khiến các cư dân tại Golden Palace bất bình khi đơn phương yêu cầu người mua phải thanh toán lần cuối (32% giá trị căn hộ) trước ngày bàn giao căn hộ.
Trao đổi với báo chí chiều 30/9, Phó chủ tịch Hội đồng Quản trị Mai Linh, bà Nguyễn Minh Hồng cho biết, dự án Golden Palace có 592 căn được bán theo gói sản phẩm “không gian sáng tạo” và bắt đầu từ quý 3/2014, chủ đầu tư đã bàn giao 300 căn hộ cho khách hàng tự hoàn thiện để kịp tiến độ khai trương dự án vào tháng 12/2014.
Theo quy định trong hợp đồng đã ký, các căn hộ gói sản phẩm không gian sáng tạo được bàn giao thô, khách hàng tự hoàn thiện trần, sàn, tường, tự lắp đặt vệ sinh. Vì vậy, nếu khách hàng đơn phương không nhận bàn giao do chưa hoàn thành các hạng mục khác là chưa thỏa đáng.
“Trong số 590 căn hộ đã bán hết, chỉ có 27 khách hàng phản đối, đây là số ít những nhà đầu cơ, đầu tư muốn chây ì nộp tiền mới tổ chức khiếu kiện. Còn hầu hết đều hài lòng vì căn hộ bàn giao thô của chúng tôi”, bà Hồng cho biết.
Liên quan đến việc khách hàng phản đối chủ đầu tư đưa ra bảo lãnh đối với nhà thầu thi công hoàn thiện, bà Hồng nói, số lượng căn hộ bán theo hình thức tự hoàn thiện rất lớn gần 600 căn do vậy chủ đầu tư buộc phải đưa ra những hình thức quản lý chặt về kỷ luật thi công.. Chủ đầu tư phải lựa chọn, thanh lọc để tìm ra nhà thầu có năng lực thi công, có khả năng chịu trách nhiệm khi xảy ra thiệt hại cho dự án ví dụ như hỏng hóc, cháy nổ, thương vong…
Hơn nữa, chủ đầu tư cũng không áp đặt khách hàng phải ký hợp đồng với bất kỳ nhà thầu hoàn thiện nào mà chỉ là giới thiệu để khách hàng tự chọn lựa.
“Việc lựa chọn này là để bảo vệ quyền lợi của tất cả các khách hàng. Số tiền 200 triệu này được ngân hàng ký bảo lãnh và lưu lại tại ngân hàng, chủ đầu tư không nhận và cũng không hưởng lãi. Số tiền này chỉ được dùng để bảo lãnh cho trách nhiệm khắc phục, sửa chữa, bồi thường hoặc thay thế cho các thiệt hại xảy ra trong quá trình thi công”, bà Hồng khẳng định.
Vị đại diện công ty Mai Linh cũng khẳng định, với những khách hàng cố tình trì hoãn việc đóng tiền đợt cuối, chủ đầu tư sẽ chấm dứt và thanh lý hợp đồng theo các điều khoản đã ký vì hơn 500 khách hàng khác không thể bị ảnh hưởng bởi một số ít nhà đầu tư.
